These Terms of Service (“Terms”) govern access to soughtafterlabs.com and Chips & Checks, the poker tournament and league management software provided by Sought After Labs, LLC (“Sought After Labs,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms.
Eligibility and accounts
You must be legally able to enter into these Terms. Chips & Checks is invite-only. You are responsible for providing accurate information, protecting access to your account and devices, and notifying us of suspected unauthorized use.
The Chips & Checks service
Chips & Checks provides tournament-management and recordkeeping tools for friendly and home poker groups and leagues. The Service does not operate poker games, accept or hold wagers, process gambling payments, or award prizes. Group organizers and users are responsible for their activities and for complying with laws and rules that apply to them.
Acceptable use
You agree not to:
- Use the Services for unlawful, fraudulent, abusive, or harmful activity.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Interfere with the operation, security, or availability of the Services.
- Upload malicious code or use automated means to scrape or burden the Services.
- Misrepresent your identity or authority to act for a group, league, or another person.
User content and records
You retain ownership of information you submit to the Services. You grant Sought After Labs a limited license to host, process, copy, and display that information only as reasonably necessary to provide, secure, and support the Services. You represent that you have the right to provide the information you submit.
SMS terms
When you request a sign-in code for Chips & Checks, you consent to receive an automated transactional SMS message from Sought After Labs or Chips & Checks at the mobile number associated with your invitation or account. Message frequency varies based on the number of sign-in requests. Message and data rates may apply.
Reply STOP to opt out. After opting out, you will receive no further messages unless you initiate a new request or otherwise provide consent again. Blocking authentication messages may prevent delivery of a requested sign-in code. Reply HELP for help or email contact@soughtafterlabs.com. Carriers are not liable for delayed or undelivered messages. Consent to receive SMS messages is not a condition of purchase.
Mobile information and messaging consent are handled as described in our Privacy Policy and are not sold or shared with third parties or affiliates for marketing or promotional purposes.
Intellectual property
The Services, including their software, design, branding, and related materials, are owned by Sought After Labs or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of the Services to you.
Service availability and changes
We may update, change, suspend, or discontinue all or part of the Services. We do not guarantee uninterrupted or error-free operation. We may restrict access when reasonably necessary for security, maintenance, legal compliance, or enforcement of these Terms.
Disclaimer
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Sought After Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from or related to the Services. Some jurisdictions do not allow certain limitations, so portions of this section may not apply.
Termination
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe these Terms have been violated, access creates risk to the Services or others, or suspension is required by law. Provisions that by their nature should survive termination will survive.
Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms here and revise the effective date. Continued use after updated Terms take effect constitutes acceptance of the revised Terms.
